Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the CalcPTwebsite, applications, and services (collectively, the “Service”) provided by CalcPT, LLC (“CalcPT,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Not Medical Advice

CalcPT provides computational tools for licensed clinicians; it is not medical advice. Output from any calculator is informational only and is not a substitute for professional clinical judgment, diagnosis, or treatment. You are solely responsible for any decisions you make based on information produced by the Service, and you agree that you will not rely on the Service as the basis for any clinical decision.

2. Acceptable Use

CalcPT is offered free of charge and without an account. You agree not to: (a) use the Service to violate any law or regulation; (b) attempt to reverse engineer, scrape, or overload the Service; (c) submit protected health information (PHI) to any field that is not expressly designated for PHI, including the bug-report form; (d) resell or redistribute the Service without our prior written consent; or (e) interfere with the security or integrity of the Service.

3. No Fees

CalcPT is currently provided free of charge. We may introduce paid features in the future; if we do, we will update these Terms and give reasonable notice before any previously free feature becomes paid.

4. Content Ownership

The Service, including its software, text, graphics, logos, and underlying methodology, is owned by CalcPT, LLC or its licensors and is protected by United States and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of the inputs you submit. You grant us a limited license to process those inputs solely to operate and improve the Service.

5. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if continued provision of the Service is no longer commercially viable. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALCPT, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS (US $100) OR (b) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless CalcPT, LLC from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

9. Governing Law and Venue

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.
